Housing Strategies Post- Blue Moonlight

The court in the matter of the City of Johannesburg Metropolitan Municipality v Blue Moonlight Properties 39 (Pty) Ltd and Another 2012 (2) SA 104 (CC)(“Blue Moonlight”)ordered that the City of Johannesburg’s (“the City”) current housing policy is unconstitutional as it excluded persons evicted by private property owners from consideration for temporary accommodation in emergency situations. It further established that the City provide all persons who are faced with eviction with temporary alternative accommodation. Our clients have been offered temporary accommodation in the MBV building, Linatex and in the Ekuthuleni shelter run by the Metro Evangelical Services (“MES”). These accommodations offered to our clients have their challenges, which include rules regulating gender-segregated rooms, evictions without court orders and daytime lock-out. We will be discussing the depth of the challenges facing the inner city Johannesburg and possible mechanisms to remedy the crisis.
